Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zimblers platform ("Service") operated by Zimblers ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Accounts and Access

You must create an account to use most features of the Service. You are responsible for maintaining the security of your account credentials. You must not share your login credentials or allow others to access your account.

Each organization gets a unique branded subdomain (e.g., yourcompany.zimblers.com). You are responsible for all activity that occurs under your organization's account.

2. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit spam, unsolicited communications, or malware
• Attempt to gain unauthorized access to the Service or other accounts
• Reverse engineer, decompile, or otherwise attempt to extract source code
• Use the Service for illegal purposes or to harm others
• Resell or sublicense access to the Service without our written consent

3. Subscription and Payment

The Service is offered on a subscription basis. Paid plans are billed monthly in advance. Prices are shown in US Dollars (USD) and are exclusive of any applicable taxes.

Payment is processed by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.

4. Free Plan

We offer a free tier with limited features and usage. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

5. Your Data

You retain ownership of all data you upload or create in the Service ("Your Data"). You grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.

We do not use Your Data to train AI models or share it with third parties except as described in our Privacy Policy.

6. Intellectual Property

The Service, including all software, design, text, and graphics, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand names.

7. Availability and Uptime

We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with notice, or emergency maintenance without notice. We are not liable for downtime or service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or profits.

Our total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the three months preceding the claim.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

10. Termination

We may suspend or terminate your account if you violate these Terms, with or without notice. You may terminate your account at any time by cancelling your subscription and deleting your account from settings. Upon termination, your data will be retained for 90 days then deleted.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
